1. Accounts

When you create an account with us, you must provide accurate, complete, and current information. You are responsible for safeguarding the password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

2. Subscription and Payments

PlaceholderGen uses Paddle (paddle.com) as our payment processor for all subscriptions and credit purchases. By subscribing to PlaceholderGen or purchasing credits, you agree to the following:

• Your payment information is provided directly to Paddle and is not stored on our servers
• You authorize Paddle to charge your payment method for the subscription fee or credit purchase amount
• Paddle's use of your personal information is governed by their privacy policy (available at paddle.com/privacy)
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• Credits purchased are non-refundable and expire 3 months after purchase if unused
• We reserve the right to change our pricing with 30 days' notice to subscribers

3. Refund Policy

At PlaceholderGen, we strive to ensure your complete satisfaction with our services. Our refund policy is designed to be fair and transparent while maintaining the sustainability of our business operations.

Our refund policy includes the following terms:

• Subscription Refunds: You may request a refund within 7 days of your initial subscription purchase if you haven't used any of the subscription features or generated any images.
• Credit Purchases: As stated in our Subscription and Payments section, purchased credits are non-refundable once added to your account.
• Service Outages: If our service experiences significant downtime (more than 24 consecutive hours), we may, at our discretion, offer partial refunds or service extensions to affected subscribers.
• Refund Process: All refund requests must be submitted via email to [email protected] and include your account information and reason for the refund request.
• Processing Time: Approved refunds will be processed within 10 business days and will be issued to the original payment method used for purchase.

We reserve the right to deny refund requests that do not meet our policy criteria or that we determine to be abusive of our services. All refund decisions are final.

4. User Content

Our service allows you to create and generate placeholder images based on your prompts. You retain all rights to the prompts you provide. However, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and display the generated images for the purpose of providing and improving our services.

You agree not to use our service to generate content that:

• Violates any applicable law or regulation
• Infringes on the intellectual property rights of others
• Contains harmful, offensive, or inappropriate content
• Attempts to manipulate or bypass our service limitations

5. Privacy and Data Protection

Your privacy is important to us. Our Privacy Policy, which is incorporated into these Terms, explains how we collect, use, and protect your personal information. As outlined in our Privacy Policy, we do not store any payment information on our servers as all payment processing is handled by Paddle.

6. Limitation of Liability

In no event shall PlaceholderGen, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the service.

7. Disclaimer

Your use of the service is at your sole risk. The service is provided on an "AS IS" and "AS AVAILABLE" basis. The service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

9. Governing Law

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our service after those revisions become effective, you agree to be bound by the revised terms.

11. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the service will immediately cease.
